Quvex — Terms of Use

1. Acceptance

These Terms of Use ("Terms") are a binding agreement between you and Samuel Ehalaiye ("we", "us") governing your use of the Quvex app and related websites. By using the app you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

2. Eligibility — 18+

You must be at least 18 to use Quvex, and any person whose cycle or health information you enter must also be 18 or over. The app is not directed to children.

You may add a profile and enter information about another person only if that person knows and has agreed, which you confirm in the app for each profile. They may withdraw consent at any time, after which you must stop and delete their information. You must not:

Non-consensual tracking is a serious breach of these Terms and may be unlawful. If you breach these Terms your right to use the app ends, and we may pursue any legal remedy available to us or to the person affected.

4. Not medical advice; not a medical device

Quvex is not a medical device and does not provide medical advice. It does not diagnose, treat, cure, or prevent any condition, and it is not a method of contraception, conception, or fertility planning. It is for general understanding and support only. Always consult a qualified health professional about any medical, fertility, or reproductive-health question, and never disregard or delay professional advice because of something in the app.

5. Predictions are estimates — no reliance

Cycle predictions, phase readings, fertile-window indications, and "late" notices are estimates calculated from the dates you enter; cycles vary, so they can be wrong and are never a statement of fact about a person's body. Do not rely on the app for contraception, conceiving or avoiding conception, diagnosing pregnancy or any condition, or any decision where accuracy matters. We make no warranty that predictions are accurate and are not responsible for decisions you make based on them.

6. Partner directory and third-party links

The app is free to use, with no fees, subscriptions, or in-app purchases. It may suggest third-party "partner" businesses and link to their sites. We do not currently earn any commission from them; in future we may earn a small, disclosed commission if you visit or buy from a partner (placement is merit-based, never paid). We do not control and are not responsible for those businesses or their goods and services; any dealings are between you and them.

7. Intellectual property

The app — its software, design, content, and the Quvex name and logo (but not the data you enter) — is owned by Samuel Ehalaiye or our licensors. We grant you a personal, limited, non-exclusive, revocable licence to use the app for your own personal, non-commercial purposes. You keep ownership of the data you enter; because it stays on your device, we need no rights over it.

8. Disclaimer of warranties

The app is provided "as is" and "as available", without warranties of any kind (express, implied, or statutory, including merchantability, fitness for a particular purpose, accuracy, and non-infringement) to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or accurate. Some jurisdictions do not allow certain exclusions, so some may not apply to you. This disclaimer is subject to the consumer-rights protections in §9 and does not exclude any guarantee that cannot lawfully be excluded.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on any prediction or content (including any reproductive, contraceptive, or health decision). Our total liability for any claim relating to the app will not exceed the greater of what you paid us in the prior 12 months (for a free app, zero) or NZ$100. Nothing here excludes liability that cannot be excluded by law (such as for death or personal injury caused by negligence, or fraud). If you are a consumer in New Zealand, nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 that cannot lawfully be excluded; consumers elsewhere keep the mandatory rights of their local law. These limits apply only to the extent the law allows; where they do not, your statutory rights prevail.

10. Your responsibility

You are responsible for your use of the app, including having the consent of any person whose information you enter. To the extent permitted by law, you will indemnify us against claims arising from your breach of these Terms or misuse of the app, including a claim by a person whose information you entered without their consent.

11. Governing law

These Terms are governed by the laws of New Zealand, and you and we submit to the non-exclusive jurisdiction of the New Zealand courts. If you are a consumer, this does not deprive you of the mandatory protections of your country of residence, where you may also bring proceedings.

12. App store terms

Your use of the app is also subject to the terms of the store you obtained it from (such as Google Play, and, if applicable, the Apple App Store). If you obtained Quvex from the Apple App Store, Apple is not a party to these Terms and has no obligation to provide support; Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you; and nothing in these Terms limits liability beyond what applicable law permits. Refunds, where relevant, are handled by that store and by any mandatory refund right your local law gives you.

13. Changes; ending these Terms

We may update the app and these Terms; we will post updates here and change the effective date, and we may stop offering, updating, or distributing the app or remove it from the app stores. For changes that materially affect your rights, we will also show an in-app notice the next time you open Quvex, not only post it here. Your right to use the app (the licence in §7) ends if you breach these Terms. Because the app has no account and runs entirely on your own device, we cannot remotely disable a copy you have already installed — you can uninstall it at any time, which also removes your on-device data. The disclaimers, no-reliance terms, IP terms, and liability limits continue to apply afterwards. These Terms are written in English; if we provide a translation and it differs, the English version prevails.
